Hi for IRS n Tax purposes you are a resident alien (even though you may be a non-immigrant h1b or using EAD) that is different.
This form is not applicable to you. Tell the credit union that you are resident alien and then they will understand.
No need to fill this form.
Instead you need to apply for TIN (Tax Payer Identification Number) Form W-9 for your wife and get a TIN and use that TIN while adding as a dependent.
You can either file the TIN yourself or go to HnR block or some other service. Usually they file for TIN while filing tax return...

Hi,
We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?

Required Qualifications
A Bachelor's degree or equivalent training in Business Administration, Health Service Administration, Mathematics, Project Management or Industrial Engineering.
Five or more years of progressive experience in an exempt-level business analyst, project management or process improvement role.
My question to you is whether this job requirement classify this job in EB 2 category? Thanks.

With all the data from USCIS, FOIA and other tracker - random sampling its really hard to say. They all say different things. I think the only thing that is somewhat clear is that EB ROW is not going to use much of the visas this year and we expect some reduction in the backlog. There many estimates by people on this forum.

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.

TSC has cleared my EAD in 10 days. Applied on 27th of March 2009 and got 'Card Production Ordered' message on 9th of April 2009

I am July 2nd filer and got EAD approved.
My 485 notice has Received Date as July 19th 2007 and Notice Date as October 17th 2007.
Do i need to calculate 180 days from July 19th 2007 OR Oct 17th 2007 if i want to change the jobs?

My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.

Hello everyone,
I have been following this forum for quite sometime now. I have an issue and need some advice on that. My husband is on EAD and i am H1. I was with company A for a almost 2 yrs and then I joined company B for a project. They applied for my h1 that came through pretty fast through premium process. the project that I was supposed to start on kind of got scrapped and no dates yet known when that would happen. Now my question is that can i go back to company A as they have a project for me and want me to join them again, if i do that compant B will cancel my H1.Please advice if there are any legal issues that might pertain on this kind of case.

My Mother in law appeared at hyderabad US consulate and IO told her that she got visa but asked her to come up with new passport, becoz some letters in her current passort has faded out.
Is this happend with any one? and what we do in this situation after getting new passport?
I mean do we need another appointment or just go with new passport and drop?
Please through some thouts.

I had a really good experience in Nogales last week, I got my visa stamping on the same day of my appointment and the NVS International team was great. They arranged everything for me:transportation from the Tucson Airport to Nogales, they arranged my hotel stay, bank draft as well as transportation from the hotel to the consulate.
