Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?

Wow, very interesting. Though I might experiment with cropping (first try would be cutting off the bottom, including the one bird down there, to make it more panoramic and [hopefully] make the horizon less centered), there's not really anything that I'd change about this photo. Good work, IMHO. :)

Hello Gurus,
I am on a big confusion and dilemma, need your assistance and guidance. Here is my situation.
I am on H1B and recently terminated (July 21st), I am given 2 weeks of reverberation which ends on 4th Aug, and my last pay stub (from 1st -4th aug) comes on Aug 15th.
Now as the market is really bad, I am unable to find anyone to sponsor my H1 transfer. My wife is on F1 and I am willing to change my status from H1 to F2. Now my concerns are:
a) Is my H1B status still valid (after termination) and can I apply for change of Status to F2 now? I have read somewhere, I can apply for change of status to F2 only if I am currently on a valid status.
b) After applying for F2, before my approval of 'Change of status' if I get a job, do i need to apply another change of status application 'F2- H1B'?
c) In case i get a job after 3 months, transfer my status from F2 to H1, will i require pay stubs as one of the documents? But at this point i will not have any pay stubs as I was not working? How will the transfer go? Will there be an issue?
Please let me what are my best options right now...I appreciate all your help...

you can file for a change of status to H-1, but you cannot begin working until the change of status is approved. Alternatively, you can travel to a US Consul, obtain an H-1 visa, re-enter the US using the H-1 visa and then begin work.

Hi All,
I recently got my I140 approved and I am waiting to file my I485 as my priority date(Oct 2007) is still not current(EB2 category, India).Not sure how long it is going to take as the current backlog is July 2000 for India and China.
My brother is a citizen of the US and I need to clarify if my brother can apply for a family-based green card for me and how long does it take to get the EAD when applied through this process as compared to filing through the employer when I reach my priority date.
Also need to clarify if this process is sooner or still the same as applying through the employer.

I know this issue have been discussed several times before, but I am trying to get practical answers from Guru's.
About to apply for my Canadian PR next week and my current status is
H1B (1.5 Years Left) and US GC Status : EB-2 (India) (Aug 2006), I-140 Approved , but havent filed for I-485 yet. As one could imagine Canadian PR is just a backup and I want to understand risks and potential issues in future.
1) Does appying/getting a Canadian PR before fling I-485 a issue? I know lot of folks did it , but was trying to see how you handled the issue at 485 Stage.
2) Although, I am not expecting my I-485 dates will be current very soon, what happens in case if I apply for 485 and Canadian PR is approved.
3) Can USCIS reject your I485 process if it sees canadian PR or do they send a RFE ?? I can always say that I will forgo my canadian PR once I get US GC , but do they buy it or would they make a issue out of it.

My company had changed their Immigration Lawyer A to B.
During this process my original PERM approved notification letter had been lost. I filed the I-140 on 6/14/2007 without the approval letter at Nebraska service center.
PD: 3/6/2003 (EB3 ROW)
Finger Printer: 12/6/2007.
I-485: LUD: 12/7/2007 at TSC
Labor Dept. said that they had sent, however, My previous lawyer did not have it, a new my company lawyer B did not have it, my company HR did not have it and I did not have it.
I hope USCIS will request a duplicate approval notice from DOL directly after my I-140 has been filed, and how fast DOL acts on the request?

In my job search (banking and finance jobs) there is this one question i come across on each and every job application-
"Do you now or will you in the future require sponsorship to legally work in the united states?"
and options to tick on the form are 'yes' or 'no' with no space for explanation.
So i mark 'yes' and i guess thats where my job applications get stuck.
Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?
I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.
I want to know whether i am legally required to say 'yes' beacuse i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)
OR
Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.
I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.
(There is a separate question that asks if i am legally allowed to work in the US and i answer 'yes' to that since i have an EAD)

What if the validity date of H1 is before the validity date of F1. In other words if the validity date of H1 is 10/1/2009 to 9/30/2012 and the validity date of F1 is 12/15/2009 to D/s but the approval date of F1 is on 7th Jan 2010 and the approval date of H1 is on 14th jan 2010.

Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?
