Following are my case details -

Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009

Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009

What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

Kindly suggest.

Can someone give me the site where i can get the current processing dates for PERM?
The Labour certification is going to be filed this month end, in that case how long i have to wait to file I140?
Also i heared that I140 and 485 can be filed together.
Is that true? if so what is required from my side to the attorney for those two stages.

Those who were able to upgrade to premium processing before Jul 2, did you get a new receipt number for the upgrade? Or was the old receipt number valid?

old one remains valid. Your status on that will indicate that the application has been upgraded to PP, and then the same reciept number will tell you about the decision

I applied for my concurrent filing during the July 07 fiasco. My I-140 is still pending approval. I am hoping that it gets approved within the next month or so...my question is ...when can I switch companies for a same/similar job if I wanted to? Since my I 485 has been pending for over 180 days do I need to wait for my I-140 approval? if I do have to wait, can I switch as soon as I get my 140 approval?

My fiance has a (U.S) MS degree in Chemistry but has been working on H1b as a computer programmer for the last 2 years ? All her undergraduate work has also been in the Sciences. Her GC sponsor is a software company and she will be applying as a computer programmer. Does anyone have experience with this kind of Labor Certification situation ? Thank you for any help.

Hello All,

I need some advice here. Actually I have filed two labors.
Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)

I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).

Recently (Last week) I got the labor approved from Company A (as it went to Backlog).

I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.

But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.

Any suggestions?

Hi,

My I-485 case was approved on 7/23, got approval letter on 7/30.

In August I got the Code 3 Biometrics letter and now I got it for Code 2. Two Biometrics appointment within a month!

Does this usually happen? No CPO e-mails or card yet!

Hi,
My company filed for my GC in June'07. They goofed up and filed under EB-3 instead of EB-2. The company apologized and is ready to change my filing to EB-2. I am wondering whether this would be a good step? Following are my details.
- My PD is June07
- Labor is approved (in 1 week)
- I-140 approved
- My 6 yrs on H1 were completed in July09
- I have received 3 yr H1 ext
- Me & Spouse both have received EAD (I am not using my EAD card)

I am not tracking the progress of visa number availablilty, but I presume that EB-2 would anyday be better than EB-3.
Please advise whether chnaging to EB-2 would be a good idea?

My Receipt date for 485 is july 27th 2007 and nebraska is processing applications for this date.

I applied for cross chargeability on 10th March.. Any idea how long before my case is approved? My lawyer has confirmed that its possible and he claims that it should take 4-8 weeks. I wanted to check to see what the experience of people has been so far?

Any insight is greatly appreciated! Thanks!

Hi Guru's,

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:

1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.

Q & A:

1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

Your valuable suggestions are greatly appreciated.

If your I-140 is approved then you can renew H1B for 3 years, else it will be in one year increments.
You can continue to keep h1B as long as an underlying GC application is pending.
