is this true. My mother came back last year using AP but she never got a new I-94. He AP was stamped and the validity of her stay here. So not sure if you will get a I94 or not. please eloborate.

Hi,
Please advice me on below:-
1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Hello Gurus,
I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.
My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.
Is it OK if I accept this position with double salary?

Hi,
I am currently on H1 visa while I have my wife here with me on H4 Visa. Currently my I-140 application is under processing. My wife is about to apply for a job which will result her H4 visa to be converted into H1. Could anybody suggest whether this will have any effect on our application status?

The Congressional Hispanic Caucus has sent a letter to the President asking him to terminate the controversial 287(g) program that allows local police to enforce immigration laws on behalf of the Department of Homeland Security. The CHC expressed its concerns about allegations of serious civil rights violations against Hispanics as well as recent reports of poor oversight in the program. a.) DO you need latest paystubs for filing for 485.
Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.
b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

I applied for I-485, I-140,and EAD almost 2 months ago..The package was received by USCIS but no receipts yet, no checks are cashed yet...We called and they said it may take 3 months to issue receipts...what should I expect?Receipts and approval of EAD in a month given that they usually honor the 3 months period to approve EAD?or nothing is guaranteed!!

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?
