Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

Hello,
I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?

Hello Guys
I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

My wife has H1 approved. Currentlyy she is in India. Her H1B will start from October 1st. I had 2 questions:
1. For stamping does she have to wait till Oct 1st or she can go before also?
2. Based on question 1 if she can go before oct 1st and get visa, can she enter US before 1st october?

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I have a pending I 485 under EB3 I. My wife could become a US citizen early next year. We would like to file another I 485 based on the spouse US citizen catagory.
Do I have to withdraw the I 485 filed under the EB ?
I am currently using the EAD & AP derived from the current pending I 485 what happens to them. Do I file for 2 different sets of EAD?

How much time does it take for 485 to get approved with a visa number available. I applied for 485 after my i-140 was approved. Does the priority date have anything to do with processing for 485?
Nobody know how long it takes to adjudicate I485 once your PD becomes current. A conservative guesstimate would be 6-8 months. The whole processing of I485 is driven by the PD.

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

Hi all,
I am an American and my wife is going though the green card application process. We recently received our interview date. Unfortunately, it was scheduled one day prior to our wedding ceremony which is out of the country. Our wedding is being presided over by the mayor of a fairly large city, with like 300 or so guests and at this point would be impossible to change. At the same time I hear that mixing international travel and rescheduling green card interviews is a risky thing.
We have an infopass scheduled in two weeks, and beyond the supporting documents of our flight and wedding information, is there anything else we should bring to prove that we can't possibly be at this interview? Is this something a lawyer might be able to handle better (like have more credibility)?
Anyone willing to give odds on us successfully changing our interview date?
